Medical cannabis producer and campaigner Tony Bower has avoided time in prison for cultivating a commercial quantity of a prohibited drug on the NSW mid north coast.

The 63-year old was charged a year ago after he handed himself into police the day after a raid on his Crescent Head property in South Kempsey found 280 cannabis plants.

Bower was today sentenced in the Port Macquarie District Court to 18 months to be served by way of an Intensive Corrections Order, some of which may be served by way of home detention.

A decision will be made by the Judge on the 1st of April following a home detention assessment of Bower’s property by Community Corrections.

In sentencing, Judge Leonie Flannery said she recognised “the fact that medicinal cannabis is becoming more readily available” and accepted Bower will not re-offend.

She also accepted that “the offender has acted out of compassion for people.”
