Cannabis Campaigner Fails To Stop Drugs Trial

An Auckland man campaigning to have cannabis legalised has lost his bid to stop his drugs trial next week but said he was encouraged by comments from the judge.

 

Dakta Green is facing six drugs charges and was due to go on trial in Auckland District Court next week.

 

However, he applied for a stay of proceedings on the grounds that the drugs charges against him breached his rights under the Bill of Rights Act.

 

Today in a reserved decision Judge Anne Kiernan threw out his application, saying he had produced no evidence that his rights had been breached under the Bills of Rights and his trial would go ahead.

 

However, during her ruling, she said he had produced some persuasive arguments for the legalisation of cannabis but the court was not the right place for that argument to be heard.

 

Outside the court Green said he was delighted by the judge's comments.

 

"I am grateful that the court has been receptive to our ideas, that they have made positive comments about the legalising of cannabis."

 

He said politicians should be aware that "the people are angry and we are going to change this law this year."

 

Green's trial on six charges of possessing cannabis and possession for supply will begin in court on Tuesday or Wednesday next week.
