Hydro or Not!

Greetings all

In south Australia, if you were to be busted growing a single plant , you would get an on the spot fine , which can be paid at any post office, no court or conviction, same as possesion (small amounts). But apparentely they changed the law on Hydro , were it is an offence to try to grow any this way, which shall require a court apperance & conviction. Can anybody tell me what defines Hydro,  if you had a plant in a pot of soil inside with a light hanging over it, is that considered Hydro in the laws view. Or maybe it will depend on the magistrates mood.

Ive tried reading the law, but its all to confusing for a nutter!!

Each state has different cannabis laws and different definitions. The definition of "artificially enhanced cultivation" in South Australia is linked below...

CONTROLLED SUBSTANCES ACT 1984 - SECT 4 Interpretation

 

"artificially enhanced cultivation" means—

            ( a )         cultivation in a solution comprised wholly or principally of water enriched with nutrients; or

            ( b )         cultivation involving the application of an artificial source of light or heat;

 

Note: this applys to all cannabis grown indoor or outdoor.

Possession or supply of prescribed equipment

A person who, without reasonable excuse (proof of which lies on the person)—

            ( a )         has possession of any prescribed equipment; or

            ( b )         supplies to another person any prescribed equipment; or

            ( c )         has possession of any prescribed equipment intending to supply it to another person,

is guilty of an offence.

Maximum penalty: $10 000 or imprisonment for 2 years, or both.

5—Prescribed equipment

 

For the purposes of the definition of "prescribed equipment" in section 3 of the Act, the following hydroponic equipment is declared to be prescribed equipment:

           ( a )         metal halide lights, high pressure sodium lights and mercury vapour lights of 400 watts or greater;

            ( b )         ballast boxes designed or intended for use in association with a light of a kind referred to in paragraph (a)

 

;

            ( c )         devices (including control gear, lamp mounts and reflectors) designed to amplify light or heat and capable of being used in association with a light of a kind referred to in paragraph (a)

 

;

            ( d )         carbon filters designed to filter air within a room, or from 1 area of a building to another or to outside;

            ( e )         units designed to contain plants and rotate around a light source so that the plants grow hydroponically while being exposed to a consistent degree of light or heat or both.
