Former rower escapes conviction

A man who grew 15 cannabis plants through a hydroponic operation at his home in Canberra has escaped conviction by an ACT Supreme Court.

 

Police discovered the plants when they raided Guy Terance Hawksley's home in Turner in October 2003.

 

Today the court heard he used the drug to treat pain from a back injury sustained when he was training to become an elite rower.

 

Hawksley provided results from a test for cannabis to show he was now clean.

 

Justice Terry Connolly said the man had turned his life around and was now finding alternative ways to treat the pain.

 

He did not convict Hawksley but placed him on a 12-month good behaviour bond.

He was busted 18 months before the court case but with 15 plants you would think he should have been up shit creek without a paddle.

dunno how he got away with 15 plants, but if the police come round my place and i get busted with 15 plants im saying im a pro rower up shit creek without a paddle ::D:

This is old news but I have only recently joined the forum. I know this dude! When he got busted he had 15 small plants in veg state using a hydroponic setup. What he also had which was NOT reported was 15 oz of dried buds, about 50 grams of unpressed hash and about 30 grams of pressed hash (wrapped up like lollies for the gay market). The cop in charge of the bust knew Hawksley had been dealing and seized his scales as evidence. It is my memory that Hawksley was a "wannabe" drug baron who did a deal to get himself out of the shit.

It is also very notable that the case made it to the Supreme Court rather than being dealt with in the Magistrates Court. Normally cases only go to the Supreme Court where the charge is of significant magnitude, or when the amount seized is above the threshold for simple possesion. To be given a suspended sentence on what must have been a possesion for supply charge beggars the imagination. What about straight possession?

To have walked out a free and unconvicted man speaks for itself. If any of you in Canberra know Guy Hawksley, take great care. :thumbsup:
