Cannabis crop couple to forfeit

A GOLD Coast hinterland couple convicted of drug production six years ago will lose their property to the state after failing in an attempt to overturn a forfeiture order.

 

 

 

The Court of Appeal was told in July 1999 Wayne Lawrence Crew and Judith Ann Crew were convicted of producing cannabis at their Mt Tamborine property between January 1 and April 22, 1999.

 

The court was told a police search of the property found a concealed underground cannabis nursery which contained 63 mature plants. Police also found cannabis seedlings in a tin shed on the property.

 

The Crown got a restraining order over the land because it was "tainted by criminal activity".

 

It was then a matter of getting forfeiture but a hearing on July 16, 1999, was adjourned for "negotiations between the parties" which in fact never took place.

 

A Deputy Registrar of the Supreme Court last year issued a certificate, dated March 9, 2004, that the land was forfeited as of January 16, 2000.

 

The Crews took their case to a Supreme Court judge but Justice Ken Mackenzie dismissed their application for a judicial review of the registrar's issuing of the certificate.

 

They appealed Justice Mackenzie's decision and also sought a Court of Appeal declaration that their land was not forfeited.

 

However, in an unanimous judgment yesterday, the Court of Appeal dismissed the appeal.

they dont have a damn thing to lose now id go and plant all over the country if i was them to hell with 600 make it 60,000 and see what the govt does then sorry i hate these fucking laws that stop people from useing something that actually helps them ive been smoking for 5 years now used to be on over a dozen fucking pills and all i ever need was mj and yet even when you have a reason they still fuck you every way possable
