HEALTH, AGEING AND COMMUNITY SERVICES—STANDING COMMITTEE: Presentation of report on inquiry into the Drugs of Dependence (Personal Cannabis Use) Amendment Bill 2018 pursuant to order of the Assembly of 20 February 2019.
 

 

This Private Member’s bill amends the Drugs of Dependence Act 1989 and the Criminal Code (ACT) 2002 to legalise cultivation of up to four cannabis plants and possession of up to 50g of cannabis, and to make it an offence to smoke cannabis within 20 metres of a child.

 

 

The Bill will draw a distinction between the treatment of adults and children in relation to cannabis offences and therefore potentially limit equality before the law protected by section 8 of the HRA.

Generally it will remain an offence for persons under the age of 18 to cultivate or possess otherwise legal amounts of cannabis, with a maximum penalty of one penalty unit.

This will allow children to be subject to a small fine and dealt with under the existing simple cannabis offence diversionary scheme provided in section 171A of the Drugs of Dependence Act.

The explanatory statement recognises this potential limit and includes why any limitation should be considered reasonable consistently with the framework set out in section 28 of the HRA. The Committee refers the Assembly to that statement.

Why not they already have a heap of addicts on FREE heroin,, and have been supplying them since the 70s 

can't have them burgling the Public Service

Why the fuck are they worried about indoor grows ...kinda discriminates between flat dwellers and land holders.

 

Should be a bill to remove cannabis from the drugs of dependence act 1989 and swap it with coffee and tea.

 

Or alcohol ,,,,,,that'd fuck them .

Cheapest rental I could find with enough yard space for 4 good sized plants in ACT was 350 a week for a 1x1 shoebox... You'd want to install some good fencing though... otherwise rippers could strip your plant without entering the yard.

I thought the laws in ACT were pretty relaxed already. I guess more is more :)

 

Weed is considered a "dangerous substance" in QLD, a dangerous substance with no known lethal dose.

 

Not really.. If a couple of ton of cannabis happened to fall on you all at once you might be in a spot of bother.
