Here in Oz they can trademark their name, but what they can't do is patent canna. Some companies have patented the processes they use to extract and refine a specific component, but still they are unable to patent canna itself. Bedrocan's parent company is a Dutch company and Dutch law is different to Oz. They say that through breeding they have produced a specific strain, but if we have stable starter stock you and I can do the same thing. There is nothing preventing either you or I from applying for a trademark, but it's a totally different story when applying for a patent.
