The discussion in the upper house continues today...

 

Franz, in essence storing using and transmitting information about 'drug manufacture or drug cultivation' will be punishable by up to 10 years in jail... posts like my butter tutorial could potentially fall into this category, because I did knowingly transmit information that other people could use to extract cannabinoids from plant material.

 

If this passes, I may have to move to NSW where there is at least some notion of caregiving.

I all most had that issue here in qld as when i got raided i was logged into os but they by there fuck up they sat me next to my pc so i pulled the power cord so they dident see anything, and i have my pc setup so all history and cookies get removed on any reboot so when they started my pc they could not see what i was looking at...

The possession and dissemination of illicit drug 'recipes' increases the risk that individuals will either make or grow illicit drugs themselves, or incite or assist others to commit these crimes. In turn, this contributes to the problem of domestic drug production, especially in individual, addict-based or small-scale clandestine laboratories.

 

Clause 10 of the bill inserts two offences in the drugs act to deter people from obtaining and keeping information about how to manufacture or cultivate illicit drugs, or disseminating this information on the internet or in other ways.

 

New section 71E in clause 10 of the bill makes it an offence for a person, unless authorised or licensed under the drugs act or otherwise with a reasonable excuse, to possess a document containing instructions for trafficking or cultivating a drug of dependence. This offence carries a penalty of up to five years imprisonment or a fine of up to 600 penalty units, or both.

 

New section 71F in clause 10 of the bill makes it an offence for a person, unless authorised or licensed under the drugs act or otherwise with a reasonable excuse, to publish a document containing instructions for trafficking or cultivating a drug of dependence where the person intends, knows or is reckless as to whether the instructions will be used by others for trafficking or cultivating purposes. The term 'publish' as used in this section includes selling, displaying, distributing and demonstrating. The penalty for this offence is up to 10 years imprisonment or a fine of up to 1200 penalty units, or both.

 

Oh and home owner's, if you let someone manufacture or cultivate 'drugs' in your house the bill proposes you should go to jail for up to 5 years.

Just an update after speaking with some of Melb's far left wingers... Vic law does already have scope to charge people for possession of "instructables", the big change is the removal of intent from some of the definitions in the act.

Just another push to monopolies the industry. Ive always said if they make it so only they can supply, they will increase penalties on related charges.

Its such a shame when we already know what opportunities do exist for economy, employment, research and we wont mention the good will or anything like that.

I cant have a back room card hussle, but they can whak up a massive casino. I cant produce and sell my own liquor or tobacco cos they cant get thier finger in my pie, now they tellin me theyre gunna grow, produce and supply cannabis...but want to increase penalties for who have do the exact same thing?

How about your my leaders, im just following your fine example. You wish to help some people, who you deem needing? So do we.... you want to regulate and supply to unwell people without them being charged as criminals? So do we!!! Want to lock us up for doin what you do? For shame!
