NSW: what if you got caught with one plant?

Recommended Posts

Hi all,

Purely theoretical question.

Realistically speaking, what should you expect if you get caught growing one cannabis plant for personal use in NSW?

Assuming you scrub the smell and don't steal electricity, would the coppers even care? Or would they really go the full stretch and waste tax payer money on dragging you to court etc?

Anyone with the unfortunate experience who can weigh in?

Too many variables to speculate, depends on;

how old you are,

what kind of record you have,

what kind of coppers bust you,

has anyone dobbed you in/made a complaint to police,

is it medicinal,

are you terminally ill

is it indoors or outdoors

are there children involved

are there other drugs/illegal goings on happening at residence

Too many variables to speculate, depends on;

how old you are, 30-35

what kind of record you have, clean

what kind of coppers bust you, -

has anyone dobbed you in/made a complaint to police, -

is it medicinal, no, but I could claim it relieves social anxiety (have mild autism spectrum disorder)

are you terminally ill, no

is it indoors or outdoors, indoors

are there children involved, no

are there other drugs/illegal goings on happening at residence, no

Answers above :) Ignoring the autism which could be a mitigating factor, that seems like a fairly standard situation?

the cops only find out if someone tells them. the only way someone tells them, is if you tell someone

The best place to find out the worst case scenario is in the drugs act. http://www.austlii.edu.au/au/legis/nsw/consol_act/dmata1985256/

 and regulation http://www.legislation.nsw.gov.au/inforcepdf/2006-509.pdf?id=5a570630-d15d-11dd-8faf-00144f4fe975

Good luck with the grow!

Aside from freak accidents, or rank stupidity, Ford is correct, the coppers generally only find out about indoor grows if someone tells them, the mantra no smell, no sell, no tell is a good one to follow.

NSW coppers and 1 plant, indoors or out, they will be sent round by their commander to bust you.  Their personal views may well be "who gives a fuck", but this is the bread and butter of NSW policing.  Short of acting like a dick about it though, you would likely walk out of court (going on the info above) with a fine and no conviction recorded, probably a cannabis caution, and maybe have to do a program to get off the evil weed.

At the end of the day, it's like everything else in life, you have to weigh up the risks against the rewards and decide whether or not it's worth it to you, and be prepared for the potential consequences of your decisions.
