Oral swabs by LAPD at all checkpoint New Years!

So, I was reading an article about how the LAPD are going to be deploying oral swab testing for drugs other than alcohol you know like Mary, but what if let's say you smoked 4 hours prior or 2 days prior and it's still in your system hypothetically doesn't make you pop dirty on those test's. 

How is that fair I understand the basis of what they are trying to do but it doesn't seem something like that could hold up in court especially with all the false positives oral swabs give. Which would be topic for another debate I guess now you have to get a designated driver even when you smoke a lil shit he better be clean and sober cause it might all back fire on you. If you smoked 4 hours prior or 2 days ago... it wont show in an oral swab.
