Dear Manager

This letter has been sent to a wide range of managers of retail and supply outlets selling hydroponic equipment.

On 22 March 2004, the Cannabis Control Act 2003 will come into operation. Among various changes, the Act provides that a person who sells or supplies, or offers to sell or supply to another person, any thing that the person knows will be used to cultivate prohibited plants (including cannabis) by hydroponic means commits an offence. The offence will normally be prosecuted in the court of petty sessions where a penalty of $2,000 and/or 2 years imprisonment will apply on conviction.

In addition, a court convicting a person of the offence may, on the application of the Director of Prosecutions or police prosecutor, order that person be prohibited for a period set by the court (but not exceeding two years) from selling or supplying, or offering for sale or supply, to another, anything that may be used to cultivate plants by hydroponic means.

The changes to the legislation will be accompanied by a program to ensure that the general community is informed about the nature and implications of the Cannabis Control Act 2003.

If you would like more information about the Cannabis Control Act 2003, please call the Alcohol and Drug Information Service on (08) 9442 5000 or toll-free for country callers on 1800 198 024.

I reckon any hydro shop selling "Canna" or "Dutch Master" or similar products will have a hard time explaining themselves under these laws.

Maybe if they just whack a "great for hydroponic herb gardens" sticker on it and another that says that "This product is not to be used for the purposes of growing illicit plants” there are always a few loopholes in new laws. Everybody would know exactly what herbs they would be used for but I don't reckon the cops are going to go to all that much trouble to bust a few home growers now that it's just a fine or bit of drug education and the big commercial growers they are concentrating on don't usually buy through the local hydro store. :D
