Medicinal excuse fails

A WOMAN who was using marijuana for "medicinal purposes" will pay $900 in fines, Mount Isa Magistrates Court heard yesterday.

 

Sallyanne Machin pleaded guilty to one charge of possessing dangerous drugs and one charge of possessing utensils or pipes used in relation to drugs.

Police prosecutor Sergeant Vaughan Cooper told the court on October 19 at 7am police executed a search warrant at Machin's home where they found a bowl containing less than a gram of cannabis, a clip seal bag with three grams of cannabis and two water pipes used as bongs.

Sergeant Cooper said Machin told police "it's all in the bedroom" and "I take it for medication".

Defence lawyer Mr Hanly said Machin was using the marijuana medicinally for a back problem.

Mr Hanly said Machin was on an elective surgery waiting list and hadn't wanted to take prescribed vallium because it was addictive.Magistrate Rod Madsen fined Machin $450 for each charge

How is that a medical defence failing? She didn't even fight it. She just pled guilty, Only one failed here was Sallyanne.
