Hemp bars, burgers get court boost

GOODS made from hemp cannot be outlawed by the US Government's narcotics agency, under a court ruling after a two-and-a-half-year legal battle.

 

The ruling on Friday by the Ninth Circuit US Court of Appeals was hailed by a coalition of companies that make hemp-based foods including waffles, vegetarian burgers and nutrition bars.

 

The court ruled the Drug Enforcement Administration (DEA) overstepped its authority by issuing a so-called zero-tolerance rule for the active ingredient in marijuana, THC, or tetrahydrocannabinols.

 

The court ruled the DEA officials "can regulate foodstuffs containing natural THC if it is contained within marijuana, and can regulate synthetic THC of any kind. But they cannot regulate naturally occurring THC not contained within or derived from marijuana ? ie, non-psychoactive hemp products."

 

The decision was "a huge boost to the hemp food market, and we expect to see many more hemp food products on store shelves", David Bronner of the Hemp Industries Association, and maker of organic hemp nutrition bars, said.

 

"Based on today's decision, the court reasonably views trace insignificant amounts of THC in hemp seed in the same way as it sees trace amounts of opiates in poppy seeds," he said.

 

A DEA spokesman said no decision had been made on whether to appeal against the ruling.

Hell yeah, that's great news...

 

I don't get how it's not from marijuana tho... isn't the botanical definition of Cannabis sativa (L.) used for the bans as the type species to omit? And by definition, even hemp is C. Sativa, no matter how little thc is in there....

 

Still, it's good news... Always good to stick it the prohibitionists like that.

 

Maybe the FTA won't be a total loss. We can export hemp seed to em now.... ;) :;):

Strange, I thought poppy seeds were made highly illegal in every form a couple years back in the land of the free.

 

Even so, I can't believe they have to have these idiot court battles. The only reason this had to happen was because America's drug Zsar (I dunno how to spell it), deemed anyone possesing hemp beer, or hemp anything as the same as possesing a bag of gras. Some-one selling a hemp product such as hemp seed bread, or hemp beer, or even (I think) Hemp trousers, was liable for indictment for dealing drugs. Ie. Trafficing marijauana.

 

I just find it hard to believe that a place that calls itself the land of the free would even commense such non sense.

 

Still, we are talking about America.

 

thanks boulder. I was wondering if that was ever going to be overturned or not. frankly I think hemp beer should be banned. I mean you can change your state of awareness, by guzzling alcohol that's been made by rotting hemp, but you can't do the same thing with using the fresh product.

 

Fuckin hypocrits with their booze mentalities, pedalling hemp to a young crowd, who like the novelty of using their preffered drug in some way legally. While the government still condones the largest killer drug in the world, because it can tax it. it's the ultimate con job. People buying hemp beer, because of the hemp culture they come from, while really being dragged down the garden path, to "cross over" to the other side. Legally condoned brain cell killing booze. Heyuck Heyuck....them good ol boys in the white house strike again.
