Cannabis mum avoids jail

A STRATHAM woman has escaped a jail term for possessing cannabis because she used the drug to ease the pain of her chronic medical condition.

 

Rebecca Anne Miller (31) appeared in the District Court after pleading guilty to two counts of possessing cannabis with intent to sell and supply.

 

The court heard how Miller suffers from benign intracranial hypertension, or water on the brain, and smoked cannabis to help her cope with the chronic pain associated with the condition.

 

After searching Miller's house twice in October and November in 2002, police found about 600gms of cannabis as well as a set of scales and some small plastic bags.

 

Defence lawyer Rhonda Parks said Miller, who has three children who live with their father, suffered from severe migraines.

 

She said after being arrested, Miller had spent time in prison which had motivated her to get her life back on track.

 

"She is now not taking cannabis or any other prescriptive drug because she believes she is better off without," Ms Parks said.

 

"Since these offences she has straightened up her life and her children look like they are going to come and live with her again."

 

Judge Mary Ann Yeats gave Miller a suspended jail sentence, saying she understood that her use of cannabis was in some way to reduce her pain.

 

"You're not a woman that should be spending time in prison," Judge Yeats said.

 

"You should be at home looking after your children."
