A man accused of possessing 55 grams of cannabis escaped punishment yesterday after he told magistrates he needed the drug for health reasons.

 

Brad Stephens, 45, who lives with his two children, claimed smoking cannabis was a "medical necessity" which eased the pain of his crippling spinal condition. The case is believed to be one of the first in which magistrates have accepted medical reasons as a defence to possession of a large quantity of cannabis.

 

Carmarthen magistrates were told that police found the class B drug in a raid on Mr Stephens' home. He owned up to being a regular cannabis user but denied the charge of possessing the drug. His solicitor, Mike Reed, told the court: "Mr Stephens suffers from ... a degenerative bone disease of the upper spine and neck." He said that although his client has been prescribed morphine to combat the pain his body had built up a resistance so that he required increasing doses. "Large doses of morphine can seriously damage health so by taking cannabis he reduces his dependency on morphine and the potentially fatal risk. In effect, the cannabis is saving his life," said Mr Stephens.

 

The magistrates accepted it was a medical necessity for Mr Stephens to take the drug and found him not guilty of possession. But they ordered the cannabis to be destroyed. Mr Reed said afterwards: "We needed to prove that the cannabis was doing more than simply easing his symptoms. There is a legal defence of necessity but it is very difficult to succeed with." He said he believed it was the first case in which magistrates had acquitted someone solely on medical grounds.

Hi darryl d, yep save the ammo, it may come in handy in the near future,

I am at torbanlea, inland from H/Bay. As a new boy here I know maybe it takes time to "trust" but looking at your posted "use" is medicinal so maybe you have a few tips on how I  can get started, Though for many years I have used all sorts of varieties my home DIY is basic. That's a fairly old thread you've revived. I haven't seen Darryl here for a long, long time. Looking at his profile it says he hasn't been around since December '13. The best idea would be to start your own topic. At least that way you'll get direct answers to your questions. If you're not sure where to start go to the tabs at the top of this page and click on "Cannaversity" tab. It'll give you some broad ideas, from there you can start to make some plans. Ya need a plan

Lucky I just served 4 months jail for indoor medical grow for patients and my own needs. No activism in this country means we will have a hard time getting legal weed medical or rec. If u think we have medical cannibis try and find access it a joke.

I've looked into it as well because a family member has epilepsy, and it is a fuckin' joke. From Neurologists who don't want to be the first to take this route, to the exorbitant costs of it if you can even get that far (of getting a script off either GP/Specialists). Maybe once Australia gets it own supply sorted, Medical opinions and the price may change. But yeah, it's absolute BS to what's going on with it at the moment. To the point it doesn't make sense to why they bother.

Here’s another thing before they will try cannabis u must have issues or be nearly killed by big phar as poison. It’s not how it works Canada has the right idea not perfect but better than most. California is even better. But hey grow ur own make bubble hash and rosin it for pure extract. Re dry material then make coconut extract that combo is great. But the power of the herb is amazing as petroleum byproduct extraction like RSO oil still works but i would not use this. The goods come from the grower not the extraction. Message me if u need help.
