Sorry to bring a downer to the conversation, but not a good week for me. My diabetes has once again made another victim in my decrepid old body, this week I have a problem with my feet, the pain is one thing but the DR's..say this is the first stages of when, (if it gets worse and infected) they start cutting things off starting with my foot ! I just relaying this to my sons and in conversation one brought up my little indevour in the growing of my own special brand of medication. It appears ok for my doctors to prescribe ever larger doses of MS Con tin ( slow release morphine) and yet as we know it is still illegal for my medication of choice. Apart from the side affects of the legal drugs , the nauseous feelings and the constant constipation. stomach cramps etc....I get real relief, both mentally and physically from the green weed ! The current problem is that now feeling as if they are helping by discussing this and after all they are just worried about me, my kids are getting me more paranoid of being "captured" . I hoping that someone out there could tell me the legal consequences of my actions ? I'm in N.S.W and have one single plant growing at any time, sometimes I might have a smaller clone going, but basically at most 2 plants. To put my kids minds at rest and somewhat myself also, what's the absolute worst that could happen to me ? Apart from the just plain embarrassment, of my 30 year old lecturing me at 60 to be careful about my "illegal deeds" It just feels like yet another thing I have to give up in life and place it in the "never to be used again jar " along with the drinking, socializing, the sex the food, and basically everything else that goes with this frigging disease combination of old age and diabetes ! I'm determined to draw the line at having to stop a couple of cones at night when I'm alone, watching the box or playing on the net or listening to music, not hurting anyone, but "apparently" myself according to the law. With my luck I'll get caught with some heat seeking helicopter, ( according to my kids) finding my little plants and end up in jail or something ? I would appreciate any information on the subject. Again sorry for unloading , but its been a shit week !:doh:

i think you should believe in yourself and if that green works for you, obviously don't stop, we human just don't have common sense, to legalize a plant... what a head... :blink: don't think that heat seeking helicopter can get you if you only doing 1 plant, but nevertheless staying quiet and to yourself will help a lot.

Move to ACT, the only state in Australia that it's decriminalized. "One plant per household" is the general rule of thumb, but if you do get caught with it they will confiscate the plant but no penalties will be given. - Ironic, the state where all the politicians are is the only state it's "decriminalized".

 

I've done some research and this is what I've found so far, I too live in NSW, but I don't grow as it is too risky and I only have about 5g in possession at a time for personal use by myself.

 

It is an offense to cultivate cannabis. Cultivation means some activity to assist growing or harvesting. It includes planting or watering or fertilizing. Even growing one cannabis seedling is an offense.

It is also an offense to possess cannabis plants (which has the same maximum penalty as cultivation).

There are higher penalties - and trial by judge and jury - for cultivating or possessing more than 250 plants. Cases involving fewer than 250 plants are heard by a magistrate in the Local Court.

 

Always remember, if you are caught by police, you do not have to answer police questions or make a statement, even after you are arrested. Just give your name and address so that bail can be granted. Remember that the police must prove your guilt – anything you say may make it easier for them to do just that. Generally it is better to say nothing until you have had legal advice.

 

I know you are triple my age so sorry if I'm giving you a lot of useless information you already know.

 

In New South Wales, Queensland, Victoria and Tasmania, possession and use of cannabis is a criminal offence; however, it is unlikely that anyone caught with a small amount will be convicted - Granted it's your first offense regarding possession of cannabis.

 

In New South Wales, if one is caught with up to 15 g of cannabis, at police discretion up to two cautions can be issued

 

My advice is to either a) have the plants inside, granted it is difficult, but it truly is the safest way. B) Ditch the clone plants, always just have 1 plant at a time so you can't be accused of distribution, but will still be charged with possession, but it won't be as hefty. c) Ditch the plants, find a reliable seller, and buy small amounts at a time. I have been buying off the same person for the past 4 years and I buy $50 at a time, which lasts me about 4 days, it's a pain going back all the time but it's better than being caught with more.

I forgot to mention, that we all believe that marijuana should be legalized, I mean it's a natural plant for goodness sake! Don't let the laws get you down, enjoy your smoke and relax, as it was meant to be. Keep it to yourself and be very discreet, and only in the privacy of your own home! Not in the backyard, neighbours might hear you and smell it and dob you in, in the house and blow it out the window!

Hi Badhabits, what you are doing is very minor infringement in the eyes of the police. Dont know why your kids are worried so much , could it be 'cause they dont want the 'shame' of their father being in trouble with the law , then tell them to walk a mile in your shoes ... tell the kids to butt-out you, are old enuf to make your own decisions ..

 

you will not go to jail on 1st offence of one plant alone, so there is no sane reason for your children to be intervening and trying to influence your life choices',

do you still rule their lives, No .. well tell them there will be no further discussion concerning your garden contents , if they dont like that, then they have a very very self-centered and selfish view on the subject.

there is nothing for them to 'worry' about .. there is nothing to fear but fear itself

 

whom amongst my children is so perfect that they can cast judgement upon my actions, my way of life?

hey mate, sorry to here about the shit ya going through :/

i also live in nsw and have recently been busted :wacko: .... the law for cannabis in NSW is the - DRUG MISUSE AND TRAFFICKING ACT 1985

i dunno about what mattie is going on about, you`re not allowed to grow cannabis in any state or territory in Australia :ack:

 

to have 5 or less plants in NSW is a summary offense....that means it can be dealt with in local court ..... 5 is classed as "small" scale cultivation and i highly doubt its a jailable offense :uhhuh: ...... i got done with well over 100 and im still here :D .....mind you im still going through hell in the courts and its been 11 months :ack:
