$540 Fine For Medicinal Cannabis

A BURNETT Heads man was fined $540 for possessing cannabis which he claimed was used for medicinal purposes.

 

Peter James Spain, 57, pleaded guilty in Bundaberg Magistrates Court to possessing drugs, possessing utensils and possessing a thing to help with drug use.

 

Police prosecutor Robyn Shapcott said police searched Spain’s Aldridge Street home about 11.20am on July 15 and found three clipseal bags containing cannabis.

 

“As police explained the warrant, Spain was observed pulling a clipseal back with a green leafy substance and put it on the table,†she said.

 

Police later located two more clipseal bags of cannabis.

 

The three bags of cannabis had a combined weight of 43.5g.

 

“Spain said he had purchased it from the Caltex in front of the police station on Bourbong Street,†Sgt Shapcott said.

 

Defence lawyer Kel Pearson said Spain was a self-employed boilermaker.

 

He said Spain broke his back about 10 years ago and struggled to use pain killers because they induced heart attacks.

 

“He has spoken with his doctor to try and organise some alternative pain relief,†he said.

 

Mr Pearson said Spain had suffered a total of seven heart attacks.

 

Spain’s criminal history was limited to three previous charges, which were all drug related.

 

Magistrate Jennifer Batts fined him a total of $540 for all three charges.

He so could have got off with a good lawyer, but the thing thats got me thinking is why did the cops even raid him anyway? Its not like any sane person is going to see cops at the door, invite them in and throw a bag of weed on the coffee table infront of them for the hell of it.

 

Gotta admit that I liked the part about buying it opposite the cop shop. That must have really hurt the pigs' feelings knowing that they can't even effectively police the area directly opposite them :whistle:

Exactly ev but he pleaded guilty :faint: The judge couldn't find him not guilty then. :wallbash: He shot himself in the foot imo and got a record for nothing. :doh:

 

Lawyers love people who plead guilty, most advise you to plead guilty to the most minor of charges. It makes their job so easy and the $$$ still roll on in for them. With GOOD legal advice this bloke could have got off easily.

true mm......however its good that the judge recognized that he used it for med use. :freak: (it would seem)

if more people get their story across, the cunce will have to listen, and that will be a foot in the door :scratchin: .........its just unfortunate that its gonna take years of people having their lives turned upside down from home invasions by the filth :thumbdown:
