Does 2 plants mean per household or per person in a household in WA?

Hi all...back again.

 

After looking through the wording in the drugaware.com.au brochure "There are New Laws on Cannabis in Western Australia", it would seem that a CIN would only be issued if two plants were found per household, not per person in the household....does that seem right?

 

"•possession by an adult of no more than two cannabis plants under cultivation at

that person’s principal place of residence provided that the plants are not

hydroponically grown and that no other person is growing other cannabis plants

on the same premises - (penalty $200)"

 

Also, the article that Phreak1987 linked seems to support this in the explanatory notes...

" Subclause 7(2) defines the circumstances in which a CIN may be issued

(2) alleged offence involves not more than 2 cannabis plants all of which are located on the same premises.

unless someone else took the rap for a number of the plants, which wouldnt work cos if they were in the same grow room they'd just lump you both in on the same charges and same number of plants.

dosent matter if you have a building, house or flat.. if you have 10 people living in the premises or 1person that are all dope smokers and growers.. its 2 per premises

 

but i dont even know if this law even exists any more... isnt it illegal to poses grow in every state of Australia atm ?

nope, barnet tried to repeal the WA laws to make the decrim no plants and 10g (instead of 2 outdoor and 30g) but it didnt have enough support, im not sure about the other states.

my study in regards to the possession and cultivation of cannabis is a little out dated

It was never tabled in parliament they were to busy passing the search laws.

2 outside plants can fetch a fine of up to 1000.00
