What constitutes a hydroponic plant in WA?

Hi all:)

 

I've had a good search and besides finding information about SA and their hydroponics rules, can not find any information on what legally constitutes a hydroponic grow in WA. I'm wondering if it is the nutrients, the artificial lighting setup and/or the media used.

 

Any insights would be greatly appreciated.

that was a exame question

and soil-less culture was the only correct answer

This might help. Explanatory note from Subclause 7 (2)

"The term "hydroponic cultivation" is intended to have its ordinary

meaning, that is cultivation by placing the roots of a plant in a liquid

nutrient solution rather than in soil."

we need to check the laws definition of hydro to be sure

if it is defined if not there is a big loop hole there

if you get charged for hydro and you can prove its not hydro you win

Thanks heaps for all the thoughtful replies. Big thanks to Phreak1987 for checking out sub-clauses - above and beyond and appreciated.

 

My hypothetical situation of a soil-based auto-pot system using nutrients and an artificial light source, would seem to be dependent on the definition....hopefully the one of a non-soil system would be used.

It has been one of the main issues with the legislation as it stands IMO, that the definition and distinction between hydroponic and non-hydroponic plants.

 

Surprised the Barnett Govt. hasn't tried to push through amendments to this so far, but perhaps the situation for the future is better than we think it might be.

 

It would be interesting to get the results from the charges made under these laws, though I doubt such details might be available to the public.
