Police net 8kg of dope during breath test

 

A MAN pulled over for a roadside breath-test in rural NSW has been charged after police allegedly found eight kilograms of cannabis in his car.

 

Officers stopped a Ford Falcon station wagon on the Sturt Highway at Gol Gol, near Dubbo, about 12.25am this morning, police said.

 

The driver, a 39-year-old Dubbo man, returned a negative breath test, but police detected a strong smell of cannabis in his car.

 

"During a search of the vehicle police will allege they located nearly eight kilograms of cannabis leaf with an estimated potential street value of approximately $60,000," police said.

 

"Police also seized a large sum of cash found inside the vehicle, suspected of being the proceeds of crime."

 

The man was charged with supply of cannabis greater than indictable quantity and dealing with property suspected of being the proceeds of crime.

 

He was refused bail to appear in Broken Hill Local Court today.

What worries me is that they don't get called out over claims like that, no one in the media would admit having enough knowledge of Cannabis to refute that claim, so the lies continue and keep getting more outrageous, we need people to start standing up and questioning these figures, start bringing attention to these deliberate inaccuracies that are obviously part of the anti cannabis propaganda flood.

 

SO they reckon leaf is worth $7,500 a pound.... ?????

The legal defintion of cannabis as defined in the Single Convention On Narcotic Drugs, 1961 (attached as the First Schedule to the Narcotics Drugs Act 1967 (Cth)) excludes the seeds and leaves when not accompanied by the tops.

ARTICLE 1

 

Definitions

 

1. Except where otherwise expressly indicated or where the context otherwise requires, the following definitions shall apply throughout the Convention:

 

( b ) "Cannabis" means the flowering or fruiting tops of the cannabis plant (excluding the seeds and leaves when not accompanied by the tops) from which the resin has not been extracted, by whatever name they may be designated.

In the High Court judgment of Yager v R [1977] Murphy J states:

 

"11. Customs Act reference to Cannabis. The Customs Act 1967 incorporated the definitions of cannabis contained in the Single Convention Article 1 on Narcotic Drugs 1961. These were "'Cannabis' means the flowering or fruiting tops of the cannabis plant (excluding the seeds and leaves when not accompanied by the tops) from which the resin has not been extracted by whatever name they may be designated"; "'Cannabis plant' means any plant of the genus cannabis" (see First Schedule to Narcotic Drugs Act 1967). (at p49)"
