.... that thing about Canada and that law where cops can now seize any assets which 'they think' 'may have been' gained from crime.

Well now we have our own Aussie bred law which is 100% the same. How proud we must be!

Rigid law docks criminals who flash the cash

KNOWN criminals flaunting unexplained wealth will have it confiscated under tough new laws targeting organised crime.

 

These figures will lose their assets even if there is not enough evidence to charge them with a criminal office, Attorney-General Robert McClelland said yesterday.

 

Mr McClelland said organised crime cost Australia at least $15 billion each year.

 

But in many cases, people who arranged crimes and profited from them were able to keep their distance from those offences and avoid prosecution, he said.

 

Mr McClelland said that unlike existing confiscation orders, new "unexplained wealth orders" would not require proof of a link to a crime.

 

"In that sense they represent a quantum leap in terms of law enforcement strategy."

 

To ensure those whose assets were confiscated were able to seek legal representation, they would be eligible for legal aid, Mr McClelland said.

 

He said legal aid commissions would be able to recover legal costs incurred by a person with restrained assets directly from the Confiscated Assets Account. The Commonwealth would then recover the amount from the person who received the legal aid, up to the value of the restrained assets.

 

Once it becomes law, the Crimes Legislation Amendment (Serious and Organised Crime) Bill, will also allow police and other members of law enforcement agencies involved in undercover "controlled" operations to do some things that would otherwise be illegal in order to obtain evidence of a serious offence.

 

"For example, a shipment of drugs might be allowed to pass through border control in order to follow the trail to the buyers or distributors of those narcotics," Mr McClelland said.

 

"There are appropriate limits on this," Mr McClelland said. "Controlled operations do not authorise conduct likely to cause death or serious injury, or involve the commission of a sexual offence."

 

He said there would be strong mechanisms in place to ensure those involved were publicly accountable.

 

The law will also increase the range of investigations in which phone taps can be used.

 

Mr McClelland said law enforcement agencies needed the new powers to defeat the sophisticated methods used by criminals to avoid detection.

That law will be challenged in the High Court very quickly I would think as it is totally in breach of the ICCPR to which Australia is signatory.

It amounts to arbitrarily depriving somebody of their property without lawful justification.

If they cannot prove a crime has been committed then the person is innocent and CANNOT be punished, like by taking all their stuff!!

 

I believe the Australian Politicians have behaved criminally towards the Australian people and have taken money under false pretences (Election promises) and should by THESE RULES have their superannuation and all other assets seized in forfeiture for their "Crimes", just cause we cannot "prove" the accusations should not stop us being able to seize their stuff.... their rules!!!!!

 

One set of rules or NO RULES....they should chose wisely

 

How much longer are Australians going to take this crap, they are supposed to do OUR will not steal our rights and property.

Someone who is fucked over can get 'free' legal aid

Not quite sure about this but it sounds like the commonwealth basically gets all the money anyway???? wtf!?

Kind of makes their anti bikie laws and these ones look rather

Its national socialism! Law by law, like slowly boiling a frog so it doesn't notice.

 

BTW, what do they think? The cops go take some "known criminals" skyline and there supposed to see the light, give up crime and turn to god or something. If they were going to make laws that goes against freedom, you'd think they'd at least dream up one that served some sort of point in keeping the community safe!

Ho Hum.... i agree, another new little law, to add to the rest of little laws that go relatively unnoticed,

slowly chipping away at what supposed freedom we have left.

Plus Electricity meters that can be remote controlled, monitored and turn on and off your electricity supply...

they want complete control, control is an ego created illusion, the harder they squeeze the more will ooze out the sides

and gather at the bottom.
