Documenting grow to prove personal use?

Hey guys,

 

Lately I have been thinking about starting a grow and finding out as much as I can about it. Being named a dealer by the law and prosecuted as one if caught would have to be the scariest part of it all. I was wondering if you documented your grow and usage would that stand up in court? I do understand it would only be your word but for someone with no prior convictions or any of that stuff would it fly?

or just thinking of documenting a grow here to prove its just personel ... if that is what you are thinking then forget it!!

Documenting everything is just giving them more evidence to screw you over. Because during a search, there's a fair chance they'll discover it. Incriminating yourself more won't soften the blow the courts will hand down. All it will do is speed up the process of doing you over, because it basically would see you pleading guilty with the said documentation. Possibly even incriminating yourself futher more.

 

Best bet, if they ever do visit with a warrant in hand. Be polite, and keep your mouth shut, don't incriminate yourself (or anyone else). Then before the court date, hire yourself a good suit (lawyer) that has had experience in the field, and put a good case foward. Also, visit your state/territory legislation website and do a search for "Drug Laws/Misuse/Regulations" and "Police Powers" and inform yourself of the laws applicable in your state/territory. Knowing where you actually stand with the laws and police powers will prove a real benefit to you, if such an event should ever unfold.

 

Remember, the officers have got to prove your guilt 'n you're not obliged to incriminate yourself any futher.

Indy just hit the nail on the head, you might as well be your own prosecutor if you do that, just handing them more evidence to use against you in court, in the eyes of the law it is still just as illegal to grow for perso as any other reason, so the best it might do is influence the Judge to go easy with the severity of any sentence, and in the end would probably doing you more harm than good.

Hmmmm, just an idea seems like a bad one. I do see how it could be used against you but the idea was the police would never get there hands on it (would be something kept online easily concealed and if needed deleted) but would document your yield and usage to prove that no one else ever got the hands on your pot for your suit to use if it would help but from the response it seems like it would hamper.

The number of plants in your grow has a lot of bearing on how sever the penalty is - check your local laws.

 

Plus having weighing instruments (scales etc) and baggies etc in your possesion also makes it hard to say you don't deal.

 

Best bet if your busted regardless of how many plants etc is to shut up and let your lawyer do his job. Say nothing.

I dunno though. I mean, if you had the plants not in your house, this would be a dumb idea. But if you had them in your house, you're fucked anyway, so it would be useful if you had to prove that it was only personal use. Whaddaya think guys?
