'Weed' in garden lands Brisbane man in court

A Brisbane man has been sentenced on drugs charges after police spied his weed-infested back garden over the fence.

 

Officers were at a neighbouring proeprty in Lumley Street, Upper Mount Gravatt, in March last year when they smelled the distinct odour of marijuana.

 

They peered over the fence into the property of 47-year-old pensioner Charles Anthony McCorley to discover a thriving backyard cannabis crop.

 

Three large marijuana plants were seen hanging in McCorley's shed.

 

A search netted 19 plants weighing a total of 70 kilograms. Police also seized a plastic bag containing a further 12.7 kilograms of marijuana leaves which McCorley said he planned to "mix with butter to make cookies".

 

In the Brisbane Supreme Court today, McCorley pleaded guilty to producing, supplying, and possessing a dangerous drug as well as permitting the use of a place for the commission of a crime and possessing a bucket bong.

 

His barrister, David Crewes, said his client suffered from bi-polar disorder and used cannabis to self medicate.

 

But Justice James Douglas said he found the scenario "problematic".

 

"Medical evidence suggests very strongly that cannabis is a depressant. Since he suffers from bi-polar, I would have thought that was problematic."

 

Mr Crewes insisted the method "worked for him", prompting a swift response from the judge.

 

"Well, it doesn't work for him now; here's here in court," he said.

 

Prosecutors said McCorley had also admitted supplying his brother with some cannabis from his garden earlier that day and that the bucket bong belonged to his sibling.

 

He told police he planted the weed six to eight months earlier.

 

McCorley was sentenced to 18 months jail, wholly suspended for three years, and was placed on probation for 18 months.

WOW. That's pretty good sentence. I would NEVER plead guilty in a case like this to " producing, supplying, and possessing a dangerous drug, and I would add that I wasn't growing Prozac.

 

This judge is fucked. Why didn't they show clinical evidence, his lawyer clearly sucked dick. "Well it worked for him". What kind of fucking defense is that?

Jesus christ!

I could probably win this case for him.

The judge is a total asshat - a depressant - what bullshit......

Good to see tho that he didn't even get a fine or time - just three years good behaviour....

I guess the real lesson here is your backyard is not a good place to grow if you have sketchy neighbours.

If - on the other hand - the sentence had been anything else I am sure I would be appealing that to a real court where everybody is just that little bit more knowledgeable than they were in this instance - clearly the judge has erred.......

 

I speak from experience here - convicted in the small court and the whole case thrown out in the big court - ;)....

The QC I had to hire tho cost a truckload of money but was worth every cent.......

Why would you admit that to the cops, let alone agreeing that weed is a dangerous drug. Pfft.. Deny, deny, deny..

 

And I also think anyone would win the case for him.. he must of paid very little for a lawyer..

 

He must of been off chops.. B)

Wonder if this judge is a medical doc.

 

Wonder if there was any evidence presented by the prosecution that cannabis is in fact a depressant.

 

Wonder what passes for 'evidence' as such. I can show you 'evidence' on Drug Free Australia's website that says that one toke of super-genetically-modified-hyper-hydro-devilweed makes anyone immediately and irrevocably psychotic.

 

Yeh, at least the guy didn't go to jail. :?
