Even if your rationalisation were correct, death penalties under old testament law were carried out by the community after due process and not by a single person 'out for revenge'.

 

Having got that out of the way I have no problems with the reintroduction of capital punishment in 'some' cases. My main concern in this area is the fallibility of the legal system and that people continue to be wrongly convicted for a number of reasons. There are of course plenty of cases where the guilt of the accused is not in any doubt whatsoever and if the crime warrants the death penalty then go for it I say.

I understand what you're saying MuA, and it certainly has merit.

I struggle with the concept.

 

We all do mate.Its called the human condition.

I know we have amongst us some very ill people that require care and that the government doesn't give a toss.

But this guy was mentally stable enough to hold down a marriage and produce 3 beautiful lil tackers. He had recently gone through a divorce and I'm sure it would have affected him - as it would ANYONE. Therefore, I stand by my original comments, shoot the f***er.

I also find 'mentaly unstable', or 'psychologically challenged' to be far too common an excuse in serious crime defences. Look at the recent bushfire tragedy. The defence barrister is already claiming that his demon defendant is psychologically challenged.

 

Lawers are dispicable....personally I loath them....but I can understand a need for them also...it's confusing and conflicting ;) these phrases are also so generic...deliberatly so...which is a help for the innocent and a hinderance in prosecuting the guilty. Be glad we dont have French Laws...guilty until proven innocent(after all it would be wrong to prosecute an innocent person, wouldn't it?...weird logic)

 

I agree these people are also terrible. But in your definition, who's to say they also aren't mentally challenged?

I don't think I gave a definition...its so hard to pin down...Only speaking from my own experience...watching a friend go through pshychotic episodes 340 days out of 365 (year)...the screaming, the angst and the shame he feels for going through it and 'Imposing' it on others...it's heartrending.

 

I also can't get past the issue of personal responsibility. I feel that our society is moving against the concept. That anything we do is not our fault.

It's an emotive issue buddy, I take no offence...you weren't screaming and frothing at the mouth.

But let me say I've been on the other side of this before....over 20 yrs ago I watched some nutjob blow the top of my fiance's skull off with a shotgun...still got a piece of her skull in my hand as a reminder...so I understand the emotions that roar through the valley of ya soul....

I'm still coming to terms with it....and I still see both sides of the matter....but no witch burnings please...let the law take care of him.

 

I'm just glad we don't have the death sentence any more. There are so many innocent ppl on death row in the US it is not funny...

and the last man to be hanged in Aus was discovered to be innocent...too late....Yes, yes, I know it's proven that this guy threw the tyke of the bridge...but he's not nessicarily EVIL...Milat, now he's EVIL...and they keep him alive...

Our society is becoming too homogenized and bland and sheep are being bred who follow blindly as long as they get their foxtel and maccas.

But the deeper subsurface problems are not being looked at...or identified....so until that happens we are stuck with debate...

Better step off ma soapbox now, somebody needs the firewood!
