Legal challenge to Australia's cannabis laws

Some of you may be aware of lightning and littlbit's pending court case - there's been a few threads on the topic here, lots of discussion and feedback, and things are finally moving. You can find details about the case and information on how you can get involved and help here:

The guys are in urgent need of support and donations. They are on disability pension and the cost of travelling to and from Court is now forcing them to choose between petrol and food on the table. I've donated $200 and helped out with costs where I can. If you can possibly afford to donate something to these guys it will make a big difference. They are fighting for our freedom and I believe this is the best chance that we have to legalise cannabis. If you can't donate cash there are many other things you can do to show your support and to give these guys the best chance possible.

 

The trial starts in November in Melbourne. Come along to show your support, visit the site and please get involved. The more people that help out and contribute here the greater our chance of success. These guys are risking everything - they've lost their jobs, their home, their quality of life, their health and freedom. The least we can do is to lend a hand in whatever way we can.

Specific documents like this I'll leave up to lightning to share if he chooses. An outline of the arguments for discussion is being prepared, but we need to be careful about what is revealed and when - we'll be able to give you the general points of law being raised but I'm not sure when court submissions will be shared.

I just thought I may be able to give some feedback as I have a number of lower court outline of submissions from the DPP and court judgments commenting on several points of law.

There is Supreme Court and other lower court matters coming up soon in Q and preparation for a High Court challenge.

I recall lightning posted something before with very similar material re: international law, medical use etc

If you get it out there I will see if any of this material is useful for you guys and send it on.

grace let's get together to discuss, we should share our arguments so that every legal battle our community faces can be armed with the same knowledge and work towards building a series of precedents. PM me a safe email address if you've got one, I think we should form a bit of a legal team on a more secure medium.

I appreciate that there is a lot of material but www.basicfraud.com is worth taking some time over, because you may well find it very profitable time very well spent. And although the arguments are destined to fail in Australian courts you could always do your own research and perhaps take a longer view: see the Human Rights Act, 1998 (UK).

I wonder how the court system in Australia would cope if everyone started pleading not guilty to cannabis offences? And backed up their defense with sound legal arguements?

 

I don't think the legal system would be able to cope at all? hmm.....
