Woman not guilty in Postal cannabis case

A woman who accepted a package from a garda dressed as a postman has been found not guilty of possessing cannabis for sale or supply.

 

Judge Patrick McCartan said that the evidence in the case had been "tampered with".

 

Ncedisannani Swana, of Castleview Walk, Swords, Co Dublin, was acquitted on day two of her trial at Dublin Circuit Criminal Court following legal argument in the absence of the jury.

 

The case concerned the delivery of a package from South Africa and addressed to a "Mr Barry Gorman" at her address.

 

Prosecuting solicitor, Garret Baker, said that Ms Swana accepted and signed for it when it was delivered by Detective Garda Willie Armstrong who impersonated a postman. The package was retrieved soon afterwards during a garda search of the house.

 

Mr Baker told the jury that Customs and Excise officers in the Portlaoise mail sorting office had originally opened this package and then handed it to gardai.

 

Mr Baker said the package was addressed to a "Mr Barry Gorman" at Castleview Walk.

 

Judge McCartan ruled that because the evidence in the case had been "tampered with" the case couldn't proceed and directed the jury to find Ms Swana not guilty.

 

She had denied possession of cannabis for sale or supply at her home on October 21, 2005.
