First conviction for drug-driving test

THE first random roadside drug testing unit to operate in NSW has recorded its first conviction.

 

The state's only roadside drug testing unit was established seven months ago, with a Winnebago van equipped to carry out tests for drug-drivers while carrying out random patrols throughout the state.

 

A 26-year-old Sydney man was today convicted of driving under the influence of cannabis after being tested by the unit near Mount White, north of Sydney, earlier this year.

 

Gosford Local Court was told that Matthew McMillan, of Glenwood, had failed a saliva test after being pulled over on the F3 freeway while travelling north at about 9.40am (AEDT) on January 22.

 

McMillan was found guilty of driving with illicit drugs present in his system and fined $500.

 

Magistrate Gary Cocks also disqualified McMillan from driving for 12 months.

 

NSW Police Force said it was the first time a conviction had been recorded for a person caught by the roadside drug testing unit since it was introduced in September 2006.

:whistle: Poor devil :toke: I wonder If he pleaded guilty or not ? Maybe I'll look him up in the phone book and see if he is listed and see if he will be interviewed for DTS ? A years suspension for testing positive to BS tests that prove nothing and certainly do not prove impairment and it took months and mucho $$$ to catch 1 toker . Its zero-tolerance (an oxyMORON) by stealth and its a bleeding outrage it is. :peace:

I would probably plead not guilty, as in, yeah I smoke but I had it hours ago offisher... and I'm not impaired now! :peace: I would request a sobriety test if I could get one. And I would demand they tell me my intoxication by way of a comparison to the equivalent of a 0.05 blood alcohol level in court.

 

I heard some guy in a Nimbin forum talking recently, I think mentioned on this forum, saying that "let's not get too far ahead of ourselves" that they've had drug driving testing in Victoria for a while now and only 26 people have been charged, and that we shouldn't worry or something. Well I would say that this charge is pretty serious, to just lose your licence at the first offence. Was there a prior conviction for other driving offences? What was the THC reading? Is this the usual punishment for marijuana driving or is this a worse than average example designed to scare people?

 

Either they are just trying to scare people, especially young people from smoking pot, and just charge a few for show or they are seriously going to end up suspending hundreds or thousands of drivers, and give them criminal records. How are these people going to get to work? Having this record will make it hard for them to apply for visas overseas, get a job or become or public servants even a politician. It's just another way the oppressors can disadvantage drug users – the legally oppressed minority underclass of this age.

 

They're bringing in this mass screening of the driving population by random saliva or mouth swab samples in Australia as a world first. We are to be the guinea pigs. They would have drug driving or intoxication laws in every country, but my understanding is that it's usually in the form of a traditional sobriety test. Maybe in some cases they test their blood.

 

I think the Courier mail recently had a story that 1 in 26 drivers had tested positive for methamphetamine and cannabis in the trial they had in Queensland just a few months back. They're bringing in full testing here this year. I personally find moderate drugged driving reasonable for a lot of the illegal drugs because they don't impair you, unless you're talking about heroin or barbiturates or horse tranquiliser maybe. The illegal drugs they test for (methamphetamine, ecstasy, and cannabis) don't impair in regular doses like alcohol does, unless maybe, you were to take all three of the above drugs in huge quantities. They always used to say that speed, alcohol, fatigue, and not wearing a seatbelt, were the big factors in car crashes. Now, suddenly they've added drugs. And they've employed their old friends from the "War on Drugs" to do their bogus studies like at the morgue taking samples and cannabis testing them and saying: "look how many people were stoned at the times they crashed!" This approach is flawed because the presence of cannabis does not confirm intoxication at the time of the crash. Pot stores in the body unlike many other drugs or alcohol. To me they're just testing how many people use pot. (Was it something like 8% they said on Catalyst?) So, there was never a "problem" with drugs and driving before, before this increased drug war started operating.

 

This is like a new phase in the drug war. If it turns out in the future, through proper testing, that in fact drugs do not impair, there will be a hell of a legal case for these prohibitionists to answer. :whistle: :toke: :toke:

well they finally got there first one feel sorry for the bugger will probably lose his job due to no licence and there goes his hopes of a V8 supercar race

 

they need to do tests into the levels of impairment as said above i have seen a vid on tests in england of driving after 1 standard joint and the guy not only passed with flying colours but did substantually better than when he was straight
