Wellington wants to shut down bar

Business' morality called into question

 

15 March, 2006, United States:

 

WELLINGTON - Sports Barn Grill & Saloon owners say just because they got caught growing dozens of unlicensed marijuana plants at home last year does not mean they should not be able to run their bar.

 

Wellington town leaders disagree and are in the process of shutting down the year-old bar by cancelling the Sports Barn's liquor license.

 

At the heart of the debate is whether growing pot constitutes "moral turpitude," or bad character. Though the town board voted to revoke the tavern's license, more than 200 people reportedly signed a petition to keep the bar open, in spite of the owners' court conviction.

 

Last year, Sports Barn owners Richard Present and Michael Farrell, both Fort Collins residents, pleaded guilty to Class 4 and Class 5 felonies, respectively, for growing marijuana. Fort Collins police said they found more than 60 plants last fall but no evidence they were selling the drug.

 

Present is [now] licensed to have a maximum of six live plants in his home as pain medication. He said he previously had a license to grow medical marijuana in California but did not apply for the license here until after he was busted in the fall.

 

Calling the dozens of pot plants and his lack of a marijuana license "a stupid mistake," Present also said he had been growing extra plants for a year's supply of medicine so his fiancee and her young son could move into his home.

 

Growing any amount of marijuana in a home in which a child is present could result in that child being removed from the home.

 

He is serving his sentence of weekends in jail and community service.

 

For the first time in at least seven years, the Wellington town board initiated a special "show cause" hearing for Present and Farrell to defend their ability to hold a liquor license. The license was to expire at the end of the month.

 

Today will likely be the tavern's last day of business, unless Present and Farrell appeal and are successful.
