Elderly drug traffickers permitted to live at home

 

The Director of Public Prosecutions (DPP) has confirmed an elderly Perth couple convicted of drug trafficking will be allowed to stay in their Carlisle home, despite it being seized under the Criminal Property Confiscation Act.

 

David and Florence Davies were found guilty of possessing 19 kilograms of cannabis with intent to supply last year.

 

The couple lost a High Court appeal against their convictions last month.

 

DPP Robert Cock says the Davies will have to sign a contract regarding the payment of rates and taxes on the property.

 

However, Mr Cock says they will be allowed to stay in their home of 50 years for as long as they want.

its good that they are able to still live at the house they lived in for 50 years but that and owning it are another story and i strongly believe they shouldnt have had their house taken from them :thumbdown

I remember the media went to town over these poor oldies when they got busted, I think if you've worked hard all your life and actually own your home with legitimate money, then you should always own it. They never proved the couple payed off their property with the proceeds of drug sales, the guy worked for it. Same as a single dad in Yangebup WA had his house seized even thought he could prove he payed it off legit. It's just wrong :thumbdown

i agree chev, its so bullshit that a law saying if you own a house and sell drugs they can take it from you, i strongly believe there should be a revision of the law that states if the person can prove they have bought the house with legit money they have earned or were given, etc. then they should be allowed to keep the house but still face what ever punishment they are given....but if they are unable to prove they bought the house legit, then i can understand the government taking the house, but from an elderly couple that have been living in the same house for 50 years is just bullshit and im suprised theere hasnt been rioting like in france

and yes if they cant prove the the house was bought using money from selling drugs then the house is rightfully theirs
