So i was found to have thc in my system by a saliva test at a roadside rbt station. Went to court, and i realize the charge is not whether or not i was under the influence, but that it was present in my system while driving. So you cant plead not guilty to a scientific fact. It was in my system. I was not stoned, but thats beside the point. Anyway, there is a MINIMUM 6 months disqualification, unless you get an exemption from the police and RTA, for work or other essential needs. The law is pretty clear but wondering what sort of lenience gets shown when the actual day in a South oz court comes if there is only a few plants involved and no prior offences. I’ve called a couple of lawyers advertising their services in this regard and they tell me that there is no lenience given and always a conviction but I guess they’re probably going to do that to get business. Would really love to hear of any case studies. Cheers P

So had my day in court with six charges -posess cannabis -produce cannabis -posess instructions -posess utensils -posess things chemicals hydro gear and a few fire works years old Baisically had 40 small plants in a tent nothing flash or crazy set up and had a few oz ended up in local court with a $1200 fine no conviction recorded and I seen a lawyer and they wanted between $5 and $10 k to represent me I just thought stuff and that went on to some forums and realised I didn’t need a lawyer hope this helps anyone looking for help or info on this topic

hey guys been away for quite a few months, knock at the door early Saturday morning.. 2 police there, long story short they got a crime stopper call in that cannabis was being grown at my address.. (a month after I harvested no live plants growing when they came) I complied, showed them the yard, told them i grew "a few" plants over summer for perso.. Got caught 4 plants, 120 gms of bud and a bong. Told the magistrate i grow for medical reasons, he told me that it was still agaist the law and he had to give me some sort of penalty and he fined me $600.00. For qld i found that reasonable, if this happened a few years ago i would have a very differe nt outcome.

In and out 15 mins - Section 10,12 months good behavior bond - didn't get to say anything, judge acknowledged that id come from from interstate and would ONLY give a section 10 bond. that was it 12 months is a bit harsh for a first offence, but better than the alternative still fucked i had to travel all this way, just to sign a bit of paper
